Issues Several Exceptions

T he Colorado Department of Public Health and Environment (CDPHE), Health Facilities and Emergency Medical Services Division (the “Division”) has issued more than 25 citations to assisted living providers issuing Immediate Jeopardy deficiencies for assisted living residences whose staff has been issued CPR and first aid certificates from online training venues. The idea is that in-person training for CPR and first aid is required to demonstrate skills, and anything less create an immediate jeopardy to the health of assisted living residents.
While the Department’s reasoning is a more than a little thin, and is certain to be challenged, it has created an uptick in investment opportunities as some assisted living providers are preparing to walk away from the business in frustration. From the altitude of the investor, the ebb and flow of regulatory frustration is to be expected. Accordingly, each surge of regulatory activity is likely to create opportunities as new operators come onto the scene.

Hey everybody, Peter Brissette here, digital marketing dude. Welcome to the Monthly Marketing Message. I wanted to talk to you this month a little bit about Google reviews, and in particular, most of our clients are in some healthcare-related industry. And I wanted to highlight some of the really important stats that are out there from a recent study put together by a company called Bright Local that manages and researches online reviews for local businesses.

Three tips for you. First of all, check your reviews. If you’re not checking and looking at your reviews, please do that. If you need help with that and you don’t have our review in marketing service, talk to us about it so that you can stay on top of that.

Secondly, I would check and see how many reviews does your close competition have. So, those folks that are five to ten miles around you, what are their reviews? How many do they have? And what’s their overall rating? That becomes your goal. Then, you know what you’re looking for, and what you’re trying to accomplish in your reviews.

And number three, ask for reviews. If you have a conversation with your clients, and they give you positive feedback, immediately ask them to leave a review, and ask them to leave it on Google first, so that you can get your Google reviews up, so that you can help improve your search rankings.

Every Year Businesses Leave Over $35 billion in Government Funds Unclaimed

-Including Thousands of Assisted Living Residences Throughout the Country.

According to studies and surveys conducted by independent think tanks, publications, and economic development organizations, billions of federal, state, and local dollars are unclaimed by small, midsize, and large employers. When people think about government incentive programs and subsidies, they believe these funds are only available for larger employers such as Amazon, Chevron, UPS, Boeing, Home Depot, IBM, or other global and national behemoths. However, when you dig a little deeper, the reality is that these funds are available to employers of all sizes , especially during the pandemic. Billions of dollars in Covid relief funding have been allocated for small and midsize businesses with five hundred (500) or fewer employees.

To provide you with how much funding is available, an employer that as few as 20 employees could receive up to $520,000 in cash. This amount of government funding is usually reserved for larger employers. However, these are atypical times. Therefore, every business, especially the hardest hit by the pandemic, such as assisted living operators, must carefully evaluate every financial program available.

Why would you want to leave money on the table if you are eligible? We do not believe small and midsize business owners do this intentionally. Usually, small businesses do not have the time to research all the funding sources available. Also, staff time and resources are necessary to claim these government dollars. Small and midsize employers also rely on well-intentioned CPAs, bookkeepers, and other trusted advisors to provide guidance. However, in the case of the CARES Act and the American Rescue Plan Act (ARPA), where billions of dollars are available for small businesses, the rules, qualifications, and guidance have changed frequently. For one of the major programs available for small business owners, the program rules changed four times. Early on in the pandemic, a CPA or bookkeeper may have reviewed the program and determined at that time that the business was not eligible. But after reviewing the most recent guidance, eligibility was now an option. Under the newest program guidelines, eligibility is highly likely for assisted living residences. Even if a business received PPP loan(s), they are still eligible.

4 Types of Social Housing and the Protections they Offer

There are four growing real estate investment classes that contribute to social betterment. Residential Assisted Living, Group Homes, Recovery Housing, and Transition Housing. Each of these housing classes is critically important for society at large and is in demand for rapidly growing populations.

Residential Assisted Living

Residential assisted living (“RAL”) is a residential property providing a home and care to between 6 to 19 residents that need assistance with the activities of daily living. The activities of daily living (“ADLs”) of primary interests are eating, dressing, showering, toileting, and mobility. When a person needs assistance with these ADLs they are considered disabled. Residential assisted living is commonly provided for residents 80 years of age and higher, that need assistance with two or more ADLs or who need assistance because of declining cognitive functions.

RALs are known by various names across the U.S, such as assisted living residences (“ALRs”), assisted living facilities (“ALFs”), residential care homes, personal care homes, and other similar names. However, they all provide a place to live, and some level of non-medical care and assistance for the residents. In contrast to multifamily real estate investments, or renting a single-family residence to one family, a properly run RAL can make between $2,000 - $10,000 in gross profit per month, depending upon the quality of care provided and other factors, while providing an important care choice for people that want higher caregiver/resident ratios and a home environment that is much more familiar than that provided by one of the large institutional facilities. There are often as many as 6 staff necessary to provide care 24/7 for 10-15 residents.

More than 10,000 people are turning 65 each day, and this is a rapidly growing demand.

However, residential assisted living is merely one form of group home that is in high demand in the U.S. There are group homes for victims of domestic violence, children with special needs, and other identifiable communities such as those described below.

Recovery Housing

Recovery Housing is housing provided for individuals recovering from drug and/or alcohol addiction. According to the Partnership to End Addiction, “Drug use is on the rise in this country and 23.5 million Americans are addicted to alcohol and drugs. That’s approximately one in every 10 Americans over the age of 12.” Only 11 percent of these receive addiction treatment. However, those recovering from addiction often need a safe place to live that provides a buffer from the triggers that may have contributed to their addiction. There are only approximately 2,500 recovery houses in the U.S. to meet the needs of this growing population. Typical rates for recovery houses are approximately $700 per bed. Staffing demands are often met by one of the residents who will serve as a house manager.

Transition Housing

Transition Housing is housing provided to people returning from the correction system during the 3-12 months needed to establish stable income and credit needed for a typical apartment, or purchase a residential home. Modernly known as Returning Citizens, these people often struggle to find transition housing because of background checks imposed by some landlords, rental prices, and other barriers to re-entry into society. According to the Department of Health and Human Services, more than 600,000 individuals are released from state and federal prisons each year. Another 9 million cycle through local jails. More than two-thirds of prisoners are rearrested within 3 years of their release and half are reincarcerated. Failure to become housed is seen as a significant contributor to homelessness leading to reincarceration. Thus, transition housing reduces homelessness, reduces crime and reincarceration, and helps reduce the labor shortage.

Transition housing is typically offered in single-family homes with rates ranging from $600 per bed to $1,000 per bed and requires very little supervision.

What Protections are Offered in the Law?

As with any investment, each of these forms of social betterment investment requires due diligence and awareness of the legal environment. Knowledge of the legal environment that protects the investor from potential interference from an HOA or the occasional neighbor, is an essential part of due diligence. The Federal Fair Housing Act Amendment is one of the most powerful laws protecting the right of residents with disability to live where they want. And it is important to understand that although you are operating a business with the property, the use of the property is widely seen as “residential” by the courts, and not commercial.

If you choose to invest in one of these social betterment classes of real estate, particularly if your residents have disabilities, the FHA may be a powerful tool for you and your residents.

When One of Your Parents Needs to Move Into a Nursing Home

Adult children sometimes find themselves in the role their parents once held: They become their caregivers when they are ill, help them with shopping and meal prep, and take them to doctor’s appointments. But what happens when one of your parents needs nursing home care? How do you find which one is best suited to their needs? And what happens to the parent left behind? Denver AALR addresses these issues below.

Finding the Right Nursing Home

For seniors that cannot live independently anymore but who do not require 24-hour medical care, assisted living residences (ALFs) are a good option. With a setting similar to a retirement home, these facilities provide assistance with daily activities such as self-feeding, personal hygiene, and functional mobility. Typically, their services include 24-hour supervision, exercise and wellness programs, dining services, and transportation.

The AHCA estimates that there are approximately 28,900 assisted living communities serving about a million seniors in the United States. Skilled nursing facilities (SNFs) are designed for seniors who are in need of daily skilled care such as intravenous injections , speech or physical therapy, or other medical services. Respite care facilities cater to patients requiring 24-hour care for a short period of time , such as after an illness or surgery. This type of care can give a much-needed break to the patient’s full-time caregiver.

Funding Senior Living

In the U.S., Medicare and Medicaid provide health insurance for people over 65 years old but generally don’t cover long-term care. A good portion of nursing home residents pay all of their nursing home costs from their own funds, and since the average cost of nursing home care ranges from $19,500 to $102,200 per year, many seniors quickly run out of money.

For this reason, purchasing long-term care insurance could be an excellent investment. LTC insurance covers assistance with activities of daily living , a disability, or cognitive impairment like Alzheimer’s disease. And some LTC plans can be wrapped into a life insurance policy.

When one spouse can no longer be cared for at home, the couple may decide to sell their house to free up cash and help pay for nursing home expenses. If your parents have lived in their home for a long time, they will need to assess the current market value of their house and subtract their assets from that market value to learn their equity. The current home equity is calculated by subtracting the amount still owed on the mortgage from the current market value of the home.

For the parent not moving into an assisted living facility, selling their home might mean downsizing or moving to a smaller space , renting an apartment, or moving in with family. Be sure to give your senior parents plenty of time to prepare for their respective moves as they’re trying to declutter and sort through a lifetime of belongings and memories.

Helping Your Parents Move

At any stage of life, moving can be a stressful process, but it can be especially frightening for older people who are used to living independently. Telling them they need to move may give them a feeling of losing control of their own life. Listen to their concerns, and make a list of their “must-haves” and “absolutely-nots” for their new abode.

Today’s housing options for seniors include accessory dwelling units or “granny pods,” active adult communities, tiny home or RV retirement communities, senior villages, and co-housing. Take them on a tour of different facilities. Do they want to be close to family or church? Are they longing for a busier social life, or would they prefer a quieter pace? Once you’ve narrowed down the options, work together to find the solution best suited to your parents’ needs.

It can be a tough day when you find out that one of your parents needs long-term care. But with careful financial planning and by listening to your aging parents’ needs and wants, you can help them move into their next home, whether together or separately. And through it all, you can be the rock they need to sustain the best quality of life possible.

This month we have CJ Thompson from Live Oak Bank presenting on SBA loans.

CJ is a Loan Officer on Live Oak Bank’s Senior Care team where he serves the seniors housing, home care and home health industries. In this role, he originates new loans, packages SBA loans, and evaluates new loan applications.

CJ joined Live Oak Bank in 2012 and has held various roles during his time at the bank. Prior to joining the Senior Care group, he was a Business Analyst for the Pharmacy lending team and responsible for
servicing the existing loan portfolio in the vertical. Expanding from this role, he worked as a Credit Underwriter for the bank specializing in credit and underwriting policies of SBA acquisition loan products.

He then moved into a lending capacity working on both the Pharmacy team and Family Entertainment team before transitioning to his current role on the Senior Care team.

This month we will have a roundtable discussion on COVID and Assisted Living. We are working with CALA to help the community unite together on how we deal with this illness, and the regulatory agencies involved.

Colorado needs Covid Recovery Centers for Assisted Living

The Colorado Assisted Living Association (CALA) is gravely concerned with the uptick in the Covid 19 pandemic and feel compelled to bring to light a major issue that needs immediate resolution.

CALA represents the assisted living industry in Colorado, an industry with 650 facilities and over 12,000 beds. We have been in contact with CDPHE for support in placement options and management of persons affected with COVID 19 since April 25, 2020 (phone calls, ZOOM, Strike Force calls, etc). To date, we still have no solution! Additionally, the ALR industry has no representation on the Strike Force Team (we have asked several times).

Care Recovery type facilities are needed to care for seniors with Covid-19, where seniors can be actively assessed and monitored by licensed health care professionals to mitigate spread of illness, manage acute symptoms, and improve outcomes to reduce undue mortality of this vulnerable population.

Assisted Living Facilities are prohibited by regulations ( 6 CCR 1011-1 Chapters 7 and 24) to manage an acutely ill resident. Additionally, in the ALF environment:
• Staff are typically non-licensed and do not possess the training required to monitor and assess for rapidly changing resident status. (these residents require RN assessments and medical management at a minimum; ALR staff prohibited from making “assessments or judgements”)
• Smaller assisted living “homes” are not able to successfully quarantine or isolate to mitigate disease spread (shared rooms and bathrooms, limited space of less than 2000 sq ft. etc)
• Cohorting of those with positive COVID-19 is not an option with limited space.
Skilled Nursing Facilities are unable to provide the much-needed care for a myriad of reasons:
• Lack of rapid admission into a skilled nursing facility unless the patient had been discharged from a hospital. Direct admission from the community can take 3 days or more.
• Regulations from CDPHE prohibit new admissions to a skilled nursing facility, once the skilled nursing facility has an outbreak of Covid 19. An outbreak is considered 2 or more people that have tested positive for Covid 19 that are currently residing at the skilled nursing facility.
• CDPHE surveys often punitive for facilities with COVID outbreaks hence they are reluctant to undergo this level of scrutiny to admit COVID positive residents from community or hospital.
• Insurance - related delays and denials.
COVID overflow sites ( like the Denver Convention Center) are MASH type units and CDPHE admits these are not approved sites for the senior population.
Our elderly population have proven that COVID 19 affects them severely and has resulted in nearly 2000 deaths (or >80% of Colorado’s 2546 deaths). They are experiencing the detrimental effects of isolation from their families and each other. Our seniors should not have to experience increased COVID -related risks, illness or mortality because Colorado is not prepared with appropriate options to manage the treatment and quarantine for our elderly who reside in care facilities, especially smaller homes.

The Colorado Department of Public Health and Environment requires that every licensed assisted living facility in CO have a Quality Management Program (QMP). It is the first thing a surveyor will ask for when they arrive on site for a survey. What is a QMP, how do I maintain it, what should I include or not include in my QMP? This presentation will help you better understand the QMP as a process.

Bill is a senior care operations and launch expert. He is skilled in new facility start-ups, employee retention, budgeting, operations management, organizational change, and strategic management in assisted living. He has launched and run both small and large assisted living communities. Bill says, “I love what I do, and I am excited to share my heart, my experience and education in caring for our most vulnerable set of individuals.” Bill is the past President of the Colorado Assisted Living Association and is active with the Colorado Department of Public Health & Environment’s assisted living advisory committee.

What’s Happening with the New Regulation for Assisted Living Residences?

For the past two years, the Colorado Department of Public Health and Environment has been completely redrafting Chapter 7 of 6 CCR 1011-1 pertaining to Assisted Living Centers. Many of you provided comments on this draft and attended the ALR Advisory Council and Town Hall meetings. The draft is about to be sent to the Board of Health.

There is still an opportunity to have your voice heard.

Here is what happens next and how you can participate:

If you believe there will be a significant negative impact on small business, job creation or economic competitiveness, you may request that DORA require CDPHE to prepare a cost-benefit analysis of the proposed rule.

The notice that DORA sends out will give the deadline for submitting the request for cost benefit analysis. To submit the request, you can click here and this will take you to the on-line form. (But don’t make this request until after DORA sends out the notice).
